Swaha Music Ltd will require the balance of any engagement fee payable to be made at least 28 days before the first function date.
If the Client cancels the booking or the event does not take place for any reason then the deposit will be forfeit. A cancellation fee of not less than one half of the agreed fee will also be applied for.
Full payment will be sought if cancellation is made within 56 days of the performance date or if Swaha Music Ltd can show that another function has been refused for the same date on the basis of this agreement.
Cancellation notification must be in writing and receipt of such notification will be confirmed in writing.
We recommend all clients take out the appropriate insurance for their events.
Swaha Music Ltd will conduct themselves in a manner befitting the engagement and will respond to the Clients requests relating to dress code, volume levels, music played, equipment location or any other reasonable request.
Swaha Music Ltd will require access to a properly earthed mains electricity supply, sufficient to allow safe usage of the required equipment for the performance. If the supply is inadequate then the amount of equipment may be reduced. The full price for the original amount of equipment will be charged.
If Swaha Music Ltd considers that the electricity supply or any other aspect of the event is unsafe then they reserve the right to refuse to start or continue the performance after consultation with the Client. The provisions of Clause 2 may also apply.
Swaha Music Ltd will not breach any rules laws or regulations, this may be set but the venue and/or the laws of the country the performance is located in.
In the unlikely event that Swaha Music Ltd is unable to attend personally due to accident or sudden illness, Swaha Music Ltd shall endeavour to provide a suitable substitute offering a similar service at no additional charge to The Client. This does not apply in circumstances detailed in Clause 11.
Swaha Music Ltd will not be liable for failing to attend a booking, where the reason for non-attendance or late arrival is caused by adverse weather conditions (including Snow & Flooding), road closure, road traffic accident, acts of terrorism, industrial action, or other unavoidable circumstances deemed beyond our control.
Swaha Music Ltd will not incur any additional liability for non-appearance.
Licences for the performance of recorded music are only required at public events. In most cases private parties, such as wedding receptions, birthdays etc which are invitation only and attract no entrance fee do not require a licence. It is the Clients responsibility to obtain such licences if required. Should Swaha Music Ltd be prevented from performing due to the absence of any appropriate licence or similar permission or should the performance be cancelled for any other reason then the provisions of Clause 2 will apply.
Swaha Music Ltd will require adequate setting up time prior to the performance and a sufficient period afterwards to dismantle and remove their equipment from the venue. The amount of time required is dependent on the package selected and the minimum time would be 3hrs, unless stated otherwise.
The Client is responsible for providing adequate supervision of all guests, staff and customers at the venue and will be liable for any loss or damage to equipment caused by guests, staff or customers.
The Client warrants that they are entitled to use the venue for the purposes of the event and performance and that the event does not breach any law, by-law or conditions imposed on the property.
The client must provide a safe and legal venue for the event. Any relevant authority, licence or permission required for the event must be arranged for by the client or their representative and copies provided to Swaha Music when required or/and requested.
Any extension of playing time is purely at the discretion of Swaha Music Ltd and may be subject to other constraints, however will do their best to accommodate any such request. Fees for extended times are at a rate of GBP 150.00 per hour . Swaha Music Ltd will have to respect the rules of the venue and its management.
The Client engaging Swaha Music Ltd, and Swaha Music Ltd accepting the engagement confirms acceptance of all these terms and conditions upon payment of deposit.
Payment of deposit will act as an acceptance of contract, failure to do so grants Swaha Music Ltd the right to void this contract and any agreements corresponding to it.
CORONAVIRUS - COVID 19: Swaha Music is currently monitoring the ongoing situation with relation to Coronavirus. At this stage, full terms and conditions as above will apply until further notice. We will continue to monitor the existing situation and action appropriate changes should businesses be called on to do so. For the time being, we advise clients to speak with their existing suppliers and also to consider what cover their insurance (if any) makes available for them.
